The Court's Clarification

The bench said, "Whether Hindutva is a religion has not been referred to the seven-judge bench. If the issue is there before the five judge bona, then they can argue that there.
We are not calling upon anyone to address this issue. We are not considering the larger issue whether Hindutva is religion."
The Court is Considering Only Two Issues
The Supreme Court is considering only two issues relating to corrupt electoral practice under Section 123 of Representation of the Peopk Act:
One, whether appeal for vote on ground of religion, caste, community and language made by a candidate would be determined in relation to his religion, caste, community and language or that of  voters.
